By accessing or using Email Assistant ("the Application", "we", "our"), you agree to be bound by these Terms of Service. If you disagree with any part of these terms, you may not access or use the Application.
## Description of Service
Email Assistant is a desktop application that provides email management functionality, including:
- Reading emails from your email account
- Sending emails
- Replying to emails
- Managing email status (marking as read, etc.)
The Application supports multiple email providers through OAuth 2.0 authentication (for Gmail) and IMAP/SMTP protocols (for other providers).
## User Responsibilities
### Account Security
- You are responsible for maintaining the security of your email account credentials.
- You must not share your OAuth tokens or authentication information with others.
- You are responsible for all activities that occur under your account.
### Acceptable Use
You agree to use the Application only for lawful purposes and in accordance with these Terms. You agree NOT to:
- Use the Application to send spam, phishing emails, or any malicious content
- Use the Application to violate any laws or regulations
- Attempt to gain unauthorized access to email accounts
- Use the Application to harass, abuse, or harm others
- Reverse engineer, decompile, or disassemble the Application
- Remove any copyright or proprietary notices from the Application
## OAuth Authentication
### Gmail Accounts
- For Gmail accounts, the Application uses Google OAuth 2.0 for secure authentication.
- You will be redirected to Google's authorization page to grant access.
- OAuth tokens are stored locally on your device.
- You can revoke access at any time through your Google Account settings.
### Other Email Providers
- For other email providers, the Application uses IMAP/SMTP protocols.
- You will need to provide your email credentials (username and password or app password).
- Credentials are used only for establishing the connection and are not stored permanently.
## Data and Privacy
- Your email data is accessed in real-time and is not stored on our servers.
- OAuth tokens are stored locally on your device.
- We do not collect, store, or transmit your email content to third parties.

## Limitation of Liability
**THE APPLICATION IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.**
To the fullest extent permitted by law, we disclaim all warranties, including:
- Warranties of merchantability
- Fitness for a particular purpose
- Non-infringement
- Accuracy or reliability of the Application
**We shall not be liable for:**
- Any indirect, incidental, special, consequential, or punitive damages
- Loss of profits, data, or other intangible losses
- Any damages resulting from your use or inability to use the Application
- Any unauthorized access to or use of your email account
- Any interruption or cessation of the Application
## Indemnification
You agree to indemnify and hold harmless Email Assistant, its developers, and affiliates from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:
- Your use of the Application
- Your violation of these Terms
- Your violation of any third-party rights
- Any content you transmit through the Application
## Service Availability
- We do not guarantee that the Application will be available at all times.
- The Application may be subject to interruptions, maintenance, or technical issues.
- We reserve the right to modify, suspend, or discontinue the Application at any time.
## Third-Party Services
The Application integrates with third-party services (Google OAuth, email providers). We are not responsible for:
- The availability or functionality of these third-party services
- The privacy practices of these third-party services
- Any issues arising from your use of these third-party services
## Intellectual Property
- The Application and its original content are the property of Email Assistant.
- You may not copy, modify, distribute, or create derivative works of the Application without permission.
## Termination
We reserve the right to terminate or suspend your access to the Application at any time, with or without cause, with or without notice.
You may stop using the Application at any time by:
- Deleting the Application from your device
- Revoking OAuth access through your email provider settings
- Deleting the `token.json` file (for OAuth-based authentication)
## Changes to Terms
We reserve the right to modify these Terms at any time. We will notify users of any material changes by updating the "Last Updated" date.
Your continued use of the Application after changes constitutes acceptance of the new Terms.
## Governing Law
These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which the Application is operated, without regard to its conflict of law provisions.
## Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
